1️⃣
Trump lawsuit against Twitter uses @Scotus Biden v. Knight — holding that Plaintiff’s threads on Twitter from his personal account were, in fact, official presidential statements made in a “public forum.” Page 6
2️⃣
Trump’s Lawsuit: “Legislators (and in multiple instances, the current VP of the US, Kamala Harris, and the former First Lady of the US, Michelle Obama) made it increasingly clear that they wanted President Trump, and the views he espoused, to be banned from Defendants’ platform.”
3️⃣
Claims Democrats threatened Twitter’s 230 protection:
“But I do think that for the privilege of 230, there has to be a bigger sense of responsibility on it. And it is not out of the question that that could be removed.” (Rep. Nancy Pelosi, Speaker of the House, April 12, 2019)”
4️⃣
Joe Biden also threatened Twitter according to Trump suit:
“The idea that it’s a tech company is that Section 230 should be revoked, immediately should be revoked, number one. For Dorsey and other platforms.” (Joe Biden/Interview in December of 2019 and published January 2020)”
5️⃣
Trump suit argues that his removal from Twitter amounts to election interference. Makes it more difficult for him to:
• Act as head of Republican Party
• Campaign for Republicans
• Fundraise for Republicans
• Campaign for 2024 nomination
6️⃣
Trump lawsuit, essentially alleges a conspiracy to suppress free speech between Twitter and Democrats.
“It is necessary in society for people to have a robust exchange of ideas, yet Dorsey and Twitter have worked closely with government actors to silence any opposing views.”
7️⃣
Trump lawsuit cites ‘Norwood v. Harrison’:
“Congress cannot lawfully induce, encourage, or promote private persons to accomplish what it is constitutionally forbidden to accomplish.” Norwood v. Harrison, 413 US 455, 465 (1973).”
8️⃣
“Section 230 is…a blank check issued to private companies holding unprecedented power over the content of public discourse to censor constitutionally protected speech with impunity, resulting in a grave threat to the freedom of expression and to democracy itself”
9️⃣
Trump lawsuit seeks:
• Reinstated Twitter accounts
• Removal of warning labels
• Declaration that Sections 230(c)(1) and (c)(2) are unconstitutional
